Kielce, 9 November 1948, 11.00 a. m. Jan Zielono from the Citizens’ Militia Station in Kielce, with the participation of court reporter Edward Pękalski, interviewed the person named below as a witness. Having been advised of the criminal liability for making false declarations and of the wording of Article 140 of the Penal Code, the witness testified as follows:

In 1944 (I don’t remember an exact date), my lodger, Józef Niedziela from Malżyce village in the Miechów district, was taken from my flat by the gendarmes.
At first, for three and a half months, he was incarcerated in the prison in Kielce, and then he was executed by a fence on Lipowa Street in Kielce at about16:30, together with four men who were unknown to me..
Their bodies were uncovered after the arrival of the Red Army, and then I recognized Józef Niedziela and saw four other unknown people. Józef Niedziela and one other man (allegedly an engineer, but I don’t know his surname or where he came from) could be identified. The three other men were unrecognizable, as the bodies were in the state of complete decomposition.
