Warsaw, 9 November 1945. The investigating judge Mikołaj Halfter heard as a witness the person specified below. Having been advised of the criminal liability for making false declarations and of the importance of the oath the witness was sworn and testified as follows:

I submit a list of people executed on 27 December 1939 in Wawer, and a report of exhumations which took place on 25, 26 and 27 June 1940 (both documents are certified copies).
(The witness submitted the abovementioned documents).
I would like to say that the list of people who were executed was made on 27 December 1939, on the execution site before the burial. I made it myself, with a friend, Ludomir Chudzicki.
We made several copies of the list, so that even though the copy which had been kept on file by the Wawer commune was burnt with other files in 1944, as a result of military action, the copy held by Chudzicki – whose signature figures at the bottom of the list – survived, and this is precisely the copy which I submit to the citizen judge.
Chudzicki died about a year ago. A copy of the exhumation report also miraculously survived, so I am able to submit a certified copy of it today. I would like to emphasise that, as the list indicates, we buried then, on 27 December 1939, at the execution site, 107 people, including the owner of the café on the corner of Widoczna Street and Rubinowa Street, Antoni Bartoszek (however after his burial the Germans ordered that his body be recovered and hanged again, and after a few days he was taken down and buried in the same spot). Apparently Bartoszek had been shot before being hanged, as I saw a bullet wound on his temple.
The list of those buried was meticulously checked, so I am certain that we found only 106 corpses at the execution site (I was present there all the time after the execution), and Bartoszek made 107 when we brought him from the front of his café.
Three or four people survived the execution, these were Piegat, Józef Wasilewski (domiciled at Sportowa Street 3 in Wawer Stary), one man from Zbytki village – I don’t remember his name well, it might have been Gawryś or Gawryszewski. I don’t remember the name of the fourth man – it might have been Jankowski. Besides these, a Jew whose name and surname I don’t remember, who had lived in Jedynak’s house, died of wounds at home on 28 or 29December (I don’t know whether he was shot at the execution site or on the way).
It is possible that some corpses were taken by the families before the burial. It is possible, then, that in total 120 people were executed.
Luckily I avoided being arrested by the Germans on 27 December 1939; although they were near the house in which I lived, they did not come to my flat. Maybe it was due to the fact that there were no footprints in the snow near my house, which testified to the fact that no inhabitants had been out when the German soldiers had been killed.
The report was read out.

In reference to the case no. P/Kos 469/45 (execution in Wawer in 1939): the name of the Jewish man shot by the Germans in Nowy Wawer on 26 December 1939 is Dessau, Jakub. He was taken from the street to the house of Franciszek Jedynak in Nowy Wawer, at Błękitna Street 83. On the second day (that is, on 27 December 1939) he died, as a result of being shot, on the way from Wawer to Warsaw for surgery.
The name of one of the citizens who managed to escape execution on 27 December 1939 is Gawryszewski, not Gawryś. The abovementioned man lives in Zbytki, in the Wawer commune. At the same time I kindly ask that you send me the duplicates of the list of the executed and the exhumation report delivered to the court on the day of my hearing on 9 November this year.
